Equipment Sale Confirmation and Purchase Agreement

1. Equipment and Price

No sales tax is collected on this order. Buyer is located in Minnesota; any applicable use tax is the responsibility of the Buyer.

2. Payment Terms

• Payment in full at time of order by credit card through the Seller's secure online checkout at cce-industries.com (Shopify Payments).
• The card billing address must match the delivery address. The person completing payment confirms they are authorized to use the card and to make this purchase on behalf of TI-ZACK, and confirms they are the same person accepting this agreement.
• Buyer agrees to contact Seller directly at admin@cce-industries.com to resolve any billing question or dispute before initiating a card dispute or chargeback. A chargeback filed without first contacting Seller for resolution is a breach of this agreement.

3. Delivery Terms

• Ships by LTL freight within 3 to 5 business days of cleared payment.
• Ship-to address is the card billing address stated at checkout. Address changes after payment are not accepted.
• Delivery requires a signature. The signed Bill of Lading (BOL) is the record of delivery.
• Inspect at delivery. Visible freight damage or shortage must be noted on the BOL at delivery and reported to Seller within 48 hours with photos. Concealed damage must be reported within 48 hours of delivery. Claims noted on the BOL are covered; unnoted claims are limited to what the carrier accepts.
• Risk of loss passes to Buyer upon delivery.

4. Warranty (Multiquip Factory Warranty)

• Covered by Multiquip's published New Product Limited Warranty for its product line, beginning at delivery. Coverage windows run up to 18 months from delivery per Multiquip's schedule.
• Warranty service is performed by Multiquip's nationwide network of factory-authorized service centers, local to the Buyer. Seller, as an authorized Multiquip dealer, will assist in locating the nearest authorized center and will stay involved until any claim is resolved.
• Warranty claims must be initiated within 30 days of the failure date.
• The manufacturer's warranty is the sole warranty on this equipment. Seller passes through the full factory warranty and makes no additional warranty, express or implied, including merchantability or fitness for a particular purpose, beyond the manufacturer's coverage.

5. Returns

• Final sale of new commercial equipment. Returns are not accepted except as required by law. Defects are handled through the Multiquip factory warranty per Section 4. Freight damage is handled per Section 3.

6. General

• This agreement is the complete agreement for this sale and supersedes prior discussions. Governed by the laws of the State of California.
• Electronic acceptance below by an authorized representative of TI-ZACK constitutes a signature under the U.S. E-SIGN Act and applicable state law.
